Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THIS SWEEPSTAKES SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.

The “Bench Customer Survey Sweepstakes” ("Sweepstakes") will begin on March 29, 2023 at 3:00 AM PT and end at 11:59:59 PM PT on April 20, 2023 ("Sweepstakes Period"). The Sweepstakes is sponsored by Bench Accounting, Inc. (the “Sponsor”) who is solely responsible for all aspects of this Sweepstakes. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules ("Rules") and the decisions of the Sponsor which are final and binding in all matters relating to the Sweepstakes.

ELIGIBILITY: This Sweepstakes is open only to (i) legal residents of the fifty United States and District of Columbia who are (ii) at least eighteen (18) years old and are also (iii) existing customers of Bench Accounting, Inc. (“Bench”) at the time of entry who receive an invitation to participate in the research study survey. Employees of Bench, or other companies associated with the promotion of the Sweepstakes, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited or restricted by law.

How to Enter: No Purchase Necessary. An eligible entrant may enter by completing the Bench Customer Survey and providing their first and last name and email address at the end of the survey. Limit one (1) entry per entrant during the Sweepstakes Period. Entrants will be required to use the primary email address registered in the entrant’s Bench client profile for the drawing entry. All entries must be received by 11:59:59 PM PT on April 20, 2023. The Sponsor’s computer, or that of its designee, runs the official clock for the Sweepstakes and will solely determine the time by which an entry is received. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. First name, last name and company name of all entrants establishes the identity of the entrant and ultimately, who the winner is. Any effort by an entrant to misrepresent themselves through the use of aliases or e-mail addresses will disqualify entries of that entrant. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Normal Internet access and usage charges imposed by your online service will apply. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who submits more than the stated maximum limit of entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes. Use of any automated system, script, macro or other means to sign-up or submit entries is prohibited and will result in disqualification of the entrant and entries or sign-ups generated by such means are void.

Prize: There are three (3) Prizes to be won in the Sweepstakes. Three winners will each receive a $100 (USD) Visa gift card (the “Prize”). All federal, state and local taxes are the sole responsibility of the winner. Total approximate retail value of the Prize is $100.00 (USD) per winner. Only the listed Prizes will be awarded. The Prizes are not exchangeable or transferable. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute the Prizes with another prize of equal or greater value.

Prize Drawing, Odds and Notification: Three (3) potential winners will be selected from among eligible entries received during the Sweepstakes Period in a random drawing conducted by Sponsor, whose decisions are final in all matters relating to this Sweepstakes. The drawing will be conducted on or about April 25, 2023. Odds of winning will depend on the total number of eligible entries received during the Sweepstakes Period. All entries have the same chance of winning. In the event that a potential winner is disqualified for any reason, Sponsor may, in its sole discretion, award the Prize to an alternate winner selected at random. The Sponsor will attempt to notify the potential winner on or about April 25, 2023. If the Prize goes unclaimed after three attempts to contact the potential winner, the Sponsor will award the Prize to an alternate winner selected at random until the Prize is awarded. Sponsor reserves the right in its sole discretion to disqualify any individual (and void their entry) it finds to be tampering with the entry process or the operation of this Sweepstakes or website, or acting in a disruptive manner or to annoy, abuse, threaten or harass any other entrant, Sponsor, or any of its representatives or to otherwise be acting in violation of these Rules.

Privacy and Publicity: All information submitted by entrants in the Sweepstakes will be subject to the Sponsor’s Privacy Policy, (https://bench.co/privacy).

General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Rules or (b) award the Prize at random from among the eligible entries received up to the time of the impairment. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Rules shall not constitute a waiver of that provision. In the event of a dispute as to any entry, the authorized account holder of the entrant used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to the primary contact e-mail address on their Bench account record.

Warranties and Consents: By completing and submitting an entry, you: (a) represent and warrant that (i) you have read, and agree to be bound by, these Rules per the instructions included in the Sweepstakes, (ii) based on the Rules, you are eligible to participate in the Sweepstakes, and (iii) you are the creator of any content or materials in your entry, all of the information provided as part of your entry is accurate, does not violate any third party’s legal rights (including without limitation rights of privacy and publicity, or intellectual property rights), your entry has not been previously published, and otherwise does not violate applicable law; and (b) agree to be bound by the interpretations of these Rules by the Sponsor which are final in all matters relating to the Sweepstakes.

Release and Limitations of Liability: By participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, their parent companies, officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize, including, but not limited to: (a) any technical errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of the Prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or the Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Delaware. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules (whether of the State of Delaware or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Delaware.
